The article discusses the concept of a legal right to development and its enforceability. It argues that the HR to development is not universally accepted and is mostly based on European-western concepts. The incorporation of western values to international law is unlikely to go frictionless, especially in African societies. The catalogue of social and cultural rights endorsed by the ICESCR is too idealistic and too detailed. The article concludes that ratifying the avowal to respect HR will not be enough to ensure their implementation.
